1. General Terms

By accessing and creating an account with Saribuko, you confirm that you are in agreement with and bound by the terms of service contained in these Terms and Conditions. By creating an account, you represent and warrant that you are at least eighteen (18) years old and have the legal capacity to agree to these Terms and Conditions.

If you do not agree to these Terms and Conditions, please do not use our service. These terms apply to the entire website, mobile application, and any communication between you and Saribuko.

2. Service Description

Saribuko provides a mobile application for tracking credit sales and managing customer receivables for sari-sari stores. Our service includes both free and premium features to help store owners manage their business operations more effectively.

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with these Terms and Conditions.

3. User Responsibilities

You agree to:

• Provide accurate and complete information when registering and using our services
• Use the service in compliance with applicable laws and regulations
• Respect the rights of other users and third parties
• Not use the service for illegal, unauthorized, or harmful purposes
• Maintain the security of your account credentials
• Not attempt to reverse engineer, modify, or distribute our software
• Not use the service to harass, abuse, or harm others

4. Payment Terms

Our Free Forever plan is provided at no cost and includes basic features for credit tracking and customer management. VIP features require a monthly subscription fee. Payment terms, pricing, and billing cycles will be clearly communicated before any charges are applied.

All payments are processed securely through authorized payment providers. Subscription fees are charged in advance and are non-refundable except as required by law.

5. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Saribuko, you consent to the collection and use of information as described in our Privacy Policy.

We implement appropriate security measures to protect your personal and business data. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

6. Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, design, trademarks, and other intellectual property) remain the exclusive property of Saribuko and Moonsail Technologies Inc.

You may not copy, modify, reproduce, distribute, or create derivative works from our intellectual property without express written permission.

7. User Content and Suggestions

Any feedback, comments, ideas, improvements, or suggestions you provide to Saribuko shall remain the sole and exclusive property of Saribuko. We may use such submissions for any purpose without compensation or credit to you.

You retain ownership of the business data you input into our system, but grant us a license to process and store such data to provide our services.

8. Service Availability and Modifications

We strive to maintain high service availability, but we do not guarantee that our service will be uninterrupted or error-free. We reserve the right to modify, suspend, or discontinue the service (temporarily or permanently) with or without notice.

We may update the App from time to time to improve functionality, add features, or address security issues. You agree that we have no obligation to provide updates or maintain particular features.

9. Account Termination

You may terminate your account at any time by contacting us at hello@saribuko.com. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms and Conditions.

Upon termination, your right to use the service ceases immediately. We may retain your data for a minimum period of five (5) years as required by applicable laws, after which it will be securely disposed of.

10. Limitation of Liability

Saribuko shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service, including but not limited to loss of profits, data, or business opportunities.

Our total liability to you for any claims arising from these Terms or your use of our service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

11. Indemnification

You agree to indemnify and hold harmless Saribuko, Moonsail Technologies Inc., and our officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or breach of these Terms.

12. Third-Party Services

Our service may integrate with or link to third-party services. We are not responsible for the content, privacy policies, or practices of such third-party services. Your use of third-party services is at your own risk.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms or your use of our service shall be resolved through binding arbitration in accordance with Philippine arbitration rules.

You agree that any cause of action arising out of or related to our service must commence within one (1) year after the cause of action accrues.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide at least 30 days' notice before the new terms take effect. Your continued use of the service after changes become effective constitutes acceptance of the revised Terms.

If you do not agree to revised Terms, you may terminate your account as described above.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Saribuko concerning our service and supersede all prior agreements and understandings.
